Update from the Service Lead – Planning Strategy and Development Management

The Committee noted the planning statistics report setting out 8 appeal decisions of which 7 had been dismissed and 1 allowed.

The Service Lead – Planning Strategy and Development Management drew Members attention to the appeal for application 20/2410/MFUL – Honiton Cattle Market that had been allowed.  Members recalled it was a redetermination of a previously dismissed appeal that had been found unsound by the High Court on the basis of concern about a statement made by the previous Inspector which had not been backed up by evidence.  The Inspector determined in this case that the development would not harm the character and appearance of the conservation area and therefore allowed the appeal.

Clarification was sought by the Chair about concerns raised by the Chair of Scrutiny on the success rate of the planning appeals statistics.  In response the Service Lead – Planning Strategy and Development Management acknowledged that the last monitoring period had been lower compared to previous years and advised this was being analysed to help understand why this was the case which would be fully addressed in the appeals monitoring report coming to Committee in September.

Delegated authority to the Service Lead – Planning Strategy and Development Management in consultation with the Chair and Ward Member to approve, subject to receipt of a Risk Prevention and Fire Safety Management Plan and full details of chemical containment measures and acceptance of these details by Environmental Health, Devon Fire and Rescue and the Environment Agency.  Conditions 4 and 5 to be amended accordingly.

Members did not feel able to approve the application without these details upfront in case there were reasons of safety and pollution arising from them which indicated that consent should not be granted.
